"What bill are we talking about?

It's S. 3804, the Combating Online Infringement and Counterfeits Act (COICA), introduced by Sen. Patrick Leahy (D-VT) and Sen. Orrin Hatch (R-UT). It's currently being considered by the Senate Judiciary Committee.

What exactly does it do?

The bill creates two blacklists of Internet domain names. The first can be added to by a court, the second by the Attorney General. Internet service providers (everyone from Comcast to PayPal to Google AdSense) would be required to block any domains on the first list. They would also receive immunity (and presumably the government's gratitude) for blocking domains on the second list.

What kind of domains can go on the list?

The list is for domains "dedicated to infringing activity," which is defined very broadly — any site where counterfeit goods or copyrighted material are "central to the activity of the Internet site" would be blocked.

What's so bad about that?

Well, it means sites like YouTube could get censored in the US. Copyright holders like Viacom argue that copyrighted material is central to activity of YouTube. But under current US law, YouTube is perfectly legal as long as they take down copyrighted material when they're informed about it -- which is why Viacom lost their case in court. If this bill passes, Viacom doesn't even need to prove YouTube is doing anything illegal -- as long as they can persuade a court that enough other people are using it for copyright infringement, that's enough to get the whole site censored.

And even without a court order, sites can get blacklisted just by order of the Attorney General -- and the bill encourages ISPs to block those sites as well. ISPs have plenty of reason to obey a government blacklist even when they're not legally required."

Not even a concern. YouTube is owned by Google which has more money than God. YouTube isn't going to be shut down and it's disingenuous to make this a scare point for your argument.

I don't buy this whole "omg they are taking away our internets" every time they try to stop pirates. Yes, I have pirated things. But I know it is illegal, and I'm not going to make up excuses or take laws to the far extremes when they threaten to try and stop the ability for people to steal other peoples works on the internet.

Suck it up and admit you break the law rather than try to make any law which even hints at threatening your free software and games seem like it's going to destroy the internet. Some "pirates" seem to have a sense that they deserve to have everything for free, and it's down right disgusting. I have to deal with people who feel this way on a daily basis.

I think you are the ignorant one if you think the people worried about this bill are honestly worried that they won't be able to see Justin Beiber's latest uploaded video if this bill passes. The real fear mongers behind the "They Tuk Ar Interwebz" are the people worried they can't get their software/games/music/movies for free if they start trying to tighten the grip a bit more.

I'm not even really in favor of the legislation but using asinine scare tactics like "They could shut down YouTube!" just makes the argument against it sound idiotic. A brief reading of the legislation shows that YouTube would not qualify.

On one hand, I don't disagree with the intent here. If I opened Jophiel's Bootleg Shanty down on the corner, I'd be shut down. If I tried selling counterfeit purses on the street, the cops would get rid of me. If I placed an ad in the paper advertising copied DVDs for a buck, I'd get shut down. If the Post Office found out I was importing illegal goods, they'd stop it at the border and charge me with a crime. So how is this really different? Downloading illegally copied material is a crime and, for lack of being able to directly prosecute a couple of guys in Scandinavia or some former Soviet bloc nation, they stop it from crossing the border.

On the other hand, the speed of the internet is significantly faster than the speed of the courts and I don't see this really stopping the serious people who dedicate their time to this. As they jump from site to site, it'll just leave a trail of obsolete blocked addresses in its wake. While my concern about abuse is low, balanced against my even lower optimism for this actually working, I wouldn't be thrilled to see it happen. I suppose it'll stop casual people who'll find themselves blocked from Pirate Bay, say "Huh" and forget about downloading the album they were going to get.

Also, that WoW thread is still full of idiots who apparently never read the bill. At least one Page 1. I didn't bother reading further than that.

You know Totalstupidty, the way you came across on the forum really doesn't help your side of the debate. You come and present your issue to the various forum users. A couple of them disagree with it and point out the evidence towards it. Instead of comming up with a counter rebuttle you restort to less-than-tasteful phrases such as

Which automatically makes the rest of us think that you have no side to your arguement. Which there are a couple people that tend to do that every time they post (sometimes in short essay format :P). While it would be nice to have new posters here on the ZAM forums, I hopefully speak for everyone here when I say that we don't want the O-board trash that you seems to drag with you.
